1. Wherever this Agreement uses masculine gender, this refers to feminine too.
2. Any use of the website and/or the application constitutes the user’s consent to accept and follow this Agreement.
3. The purpose of the application and the website is to assist in coordination of getting various services in the hospitality field from various service providers in the tourism field for the user by creating an environment that encourages communication and ordering service directly between the customer and the service provider.
4. The provisions of this Agreement will apply to any use made by the user (hereinafter: the “User” and/or the “Service Recipient”) of the application and/or the website (hereinafter jointly: the “Service Scene” or “Marketplace”) and will constitute the legal foundation to any discussion between the User and the site and/or application owner.
5. The User hereby undertakes to examine the Service Scene and its suitability for his needs and relieves the developer and owners of the Service Scene of any responsibility for damage that he sustains if he learned that the application and/or service does not correspond with his expectations and/or needs.
6. The provisions of the Agreement will apply to any engagement between the parties in the notices, whether by email, text messages, faxes, WhatsApp and/or any other form of communication (hereinafter: “messages”).
7. By using the Service Scene and its various services, the User declares that he has read the Service Agreement and accepts the terms of the Agreement absolutely. If the User does not agree to some or all of the terms of service, he is not allowed to use the Service Scene in any way.
   
   
8. The parties hereby agree that any claim about the use of the Service Scene will be filed to the appropriate court in Tel Aviv only, as they give local jurisdiction to these courts only.
9. The Service Scene includes the application and the attendant site, which are operated by the company Bell Boy Room Service Ltd. Private Company 516581913 as part of the group of services that the Company provides.
10. It is agreed that the application and/or the website are allowed to send the User emails and contact him in writing or orally about any information on campaigns, innovations in the Service Scene, sending a newsletter, advertisements from select commercial entities and the like, unless the user announces in writing that he is not interested in it.
    
    Ownership and reserving of rights
11. The Service Scene contains various materials, which are protected by copyrights, trademarks, other intellectual rights, including content, images, artwork, music, video and audio, some of which are owned by the website and some owned by third parties.
12. The User hereby undertakes to respect the copyrights of Bell Boy Room Service Ltd. to the Service Scene and any copyright of a third party.
13. The User and/or Web user and/or any third party performing actions in the Service Scene is not allowed to change, publish, transmit or transfer, take part in the transfer or sale or use the Service Scene or any par thereof for creating a derived work or exploit the Service Scene and/or the content appearing in the Service Scene, in part or in full, for any purpose, except for the purpose for which the Service Scene has been created. The Company permits the user to download data onto his personal computer for personal, non-commercial use only. This permit, like any other lawful action in the Service Scene, does not grant the user any proprietary right to the said Information in particular and the site and content appearing in the Service Scene in general.
14. The User undertakes not to upload onto the Service Scene any information of any type or kind that infringes the copyrights, trademarks and/or any other proprietary right and/or pornographic material and/or material that raises concern of slander, etc. If the User has uploaded such information and/or material, he undertakes to indemnify the Company and/or its agents and/or the operators of the Service Scene for any damage and/or expense (including attorney fees and trial expenses) that they will sustain as a result of the User’s improper behavior mentioned above.
15. The Service Scene will act immediately after giving an appropriate notice in writing to clarify any matter of a claimed infringement of copyright and/or infringement of moral right and termination of the infringement if necessary.
16. The Service Scene contains links to other websites on the Internet. The Service Scene provides these links for convenience only and it and/or its operators assume no responsibility for information appearing therein or on other websites linked to them, their validity and legality. A user requesting to make use of these links does so at his own responsibility.
17. The Service Scene owners reserve the right to close the application and/or the website, cancel or reduce or change services. In addition, the owner is allowed to change the articles of the website and/or the application from time to time.

Limitation of liability

1. The Service Scene provides an effective, convenient connection interface between service providers and suppliers of various products and the User.
2. The User hereby agrees that the sole responsibility for any information on a product and/or service and/or any representation made about a service in the Service Scene and in relation to the nature of the service or products is assumed only by the provider / supply providing / supplying that product or service alone.
3. The User hereby agrees that the owner of the Service Scene and/or the website and/or the site owners and/or establishers and/or operators and/or managers and/or any agents thereof are not responsible for any information on a product and/or service and/or any representation made about the service on the Service Scene, and the responsibility in relation to the nature of the service or product is assumed by the supplier / provider supplying / providing that product or service alone.
4. The Service Scene will not be responsible for any damage that may be sustained as a result of inappropriate or erroneous use of the information presented by various providers/suppliers. It is hereby agreed that the Service Scene will not be responsible for any damage that may be caused as a result of purchase of services and/or information and/or products directly from the providers/suppliers by the User.
5. All of the contents in the Service Scene are intended to provide general information only and do not constitute in any manner any professional consultation and/or a purchase recommendation from the Service Scene to the User.
6. The User hereby declares that he will not have any claim or argument towards the Service Scene, its managers and/or operators for purchases that he will make from the providers/suppliers and/or for damage that he will sustain, if sustained, as a result of the products and/or service that he has received from the providers/suppliers.
7. The User assumes all responsibility for selecting the course of action in relation to the proposed service and the results of these choices for him and for third parties, and accordingly will not express any argument towards the Service Scene on the matter of the services and/or the products and/or their time of delivery.
8. The User relieves the Service Scene of any responsibility for the manner of use that the User will make of the services and the information and relieves the Service Scene from any responsibility for the results of this use, both towards the User and towards third parties.
9. The Service Scene and/or its founders and/or operators and/or managers and/or any agents thereof are not responsible for the server through which the Service Scene operates will be free of viruses or other foreign components or elements that may impair or damage the personal computer of the User or other equipment of the User when he enters and/or orders services and/or uses the Service Scene. In addition, the Service Scene will not bear any responsibility for unlawful activity made by any user or third party that is not under the control of the Company. The Company will be allowed to terminate or prevent the engagement or the User’s access to any part of the Service Scene or to the entire website at any stage.
10. The Service Scene does not keep credit card information of the User and accordingly is not responsible for the leak of this information and any negligence, if any, on the part of the clearing/ acquiring company.

Giving feedback on the service

28. The Service Scene allows the user to give feedback for the service, but the Service Scene reserves the right to decide whether to publish the User’s feedback.
29. Offensive feedback written using crude language that may constitute slander will not be approved for publication, and the User hereby waives any argument towards the Service Scene in relation to publishing or not publishing the feedback that he has given.

The process of purchasing services or products

1. Any person above the age of 18 years or a corporation registered in Israel is allowed to purchase on the Service Scene. The actions performed in the Service Scene will be only for the purpose of receiving service and/or receiving information and/or ordering products.
2. Before performing the order on the Service Scene, the Web user will be asked to enter a full name, email address, telephone number and address. When making the order, the Web user will be asked to provide the details of the credit card using which he will make the purchase and the identity number of the cardholder.
3. The credit card details, and identity card number are not stored on the website’s database but at the company that performs the clearing/acquiring process.
4. The purchaser’s order to receive services and/or products will be received on the condition that the following conditions have been fulfilled: (1) approval has been given for making the transaction from the credit company of the purchaser and/or the payment has been settled in another way to the satisfaction of the Service Scene; (2) the products and/or services requested are in stock; (3) the Purchaser owns a personal email box on the Internet, unless the transaction is done by telephone.
5. Within his order, the User enters various data items into the system, based on which the cost of the service is calculated by the system or by the provider.
6. The User is responsible for the correctness and exactness of the data that he has entered and will be charged payment according to the data that he has entered. Any error in entering the data to the detriment of the User constitutes negligence on his part and accordingly he will be charged according to the data that he has entered.
7. In the case of the User having entered erroneous and/or misleading data that result in a lower than necessary charge, the worker who was sent to perform the service will report this in the Service Scene and the user will receive a message stating that he has entered erroneous details and will be required to pay the payment difference immediately in order for the order to be performed in its entirety.
8. If the user does not execute the payment difference and/or does not confirm the data that will be reported by the worker who has been sent to perform the service, the worker will not perform the work and will open an investigation in relation to the matter by the Service Scene’s support department. During the investigation period, no additional orders may be made on the Service Scene for that asset until the user confirms the details of the asset or until the investigation is concluded.

For the worker arriving and for cancellation of the service, the User will be charged NIS 100 + VAT out of the amount paid by him at the time of ordering the Service. The balance of the order amount will be made available to the User when making future orders and/or additional orders in the Service Scene.

At the end of the investigation by the support department, if it is found that the worker erred and the details of the asset as entered by the User were correct, the Service Scene will refund the user the sum of NIS 100 + VAT that was collected by it, and the asset will be released and additional orders relative to it may be placed.

If it is found that the details of the asset were indeed wrong, the User will be required to update its correct details before being able to place additional orders for that asset and pay the required payment difference.

1. The various service providers have a different billing structure – either a fixed charge rate or a variable charge rate, depending on the service type, and the User undertakes to pay the providers the appropriate payment according to the service type being purchased and according to the directions of the service provider.

Payment for services and products

39. The payment is made by credit card, and the charge is made in shekels. All prices on the website include VAT. The total amount charged will appear in the shopping basket, after approval of the order and will include all items or services ordered and the appropriate shipping gees for the order will be specified.
40. The details of the credit cards will be transferred through a secure server of the clearing/acquiring company in an encrypted manner. If nonetheless the User has chosen not to provide his credit card information, the order details may be entered for making telephone contact, in order to transfer the credit card information. The order details are kept for a limited period of just 36 months. If the order is not paid in its entirety during the 36 hours from the date it is performed by the User, the Service Scene will be allowed to cancel the order and the User will have no argument and/or claim and/or demand against the Service Scene for the said cancellation.
41. The confirmation and execution of the order are contingent to receiving approval for the transaction from the credit company through the clearing/ acquiring company. If no approval to perform the transaction is given, the service scene will inform the User, who is responsible for contacting the credit company or the bank in order to see to the appropriate credit facility. If the User has not arranged the credit facility and/or has not paid the full value of the order within 36 hours of the date of performing the order, the service scene is allowed to cancel the order and the User will have no argument and/or claim and/or demand against the Service Scene for the said cancellation.
42. The details of the action on the website, including the details of the offer and the details of the purchaser, but except for the details of the credit card, will be transferred by encrypted secure protocol (SSL), which is commonly used in electronic commerce, to the server of the clearing/acquiring company. For payments made by the Internet, the purchaser will provide the credit card information directly to the clearing/acquiring company, without it passing through the website at any stage of the purchase.
43. In the case of the User ordering bedding and towels, the minimum rental period is for 7 days, and any additional rental period is for 7 more days. It is not possible to order bedding and towels on a daily basis. If at the end of the rental period, there are shortages or unreasonable wear of the bedding and/or towels that have been ordered, the User will be charge the cost of the item/s according to the list price of the items for sale as of the date of ending the rental.

Conditions for cancellation of a transaction

44. The conditions for the cancellation of a transaction are for the definitions of cancellation of a transaction according to the Consumer Protection Law, 5741-1981, both with regard to cancellation of an ordinary transaction and with regard to cancellation of a distance selling transaction.
45. The User will be charged payment of half of the transaction amount in the case of cancellation more than 24 hours before the time of providing the service or delivering the product.
46. The User will be charged payment of the entire transaction amount in the case of cancellation less than 24 hours before the time of providing the service or delivering the product.
47. The user will be charged a delivery fee for transferring various products according to the supplier’s price list, and the sending fees will not be sent in the case of consensual cancellation of the transaction with the supplier.

Safeguarding privacy and sharing of information

1. We collect two types of information and data from our users.

• The first information type – unidentified, unidentifiable information relating to the User(s), which is collected by the User’s use of the services (“nonpersonal information”). The Service Scene is not aware of the identity of the User from which this information is collected. The information is collected with the aim of matching and offering the User services that correspond with his preferences.
• The second information type – is information that the User has announced to the website, and which allows for personal identification, i.e., information that identifies a given person (the “personal information”). The personal information that is collected in the Service Scene through its services includes information that has been given directly by the user, such as: telephone number; full name; email address, etc.

49. The Service Scene will use the personal information and statistical information that will be collected only for the purpose of the activity of the Service Scene, subject to this privacy policy and the provisions of law that cannot be subjected to conditions. In this matter, the activity of the Service Scene includes the ability to browse on the website and use the application and/or use services that are offered there.
50. The Service Scene will transfer or disclose the personal information about the User to suppliers/providers from which he has ordered a service or product, and the User gives his consent to this by transferring his details to the site for use in the Service Scene, inasmuch as it is not possible to provide services or deliver products without his details.
51. The Service Scene gathers information about the location of the User in order to provide him the best and fastest service.
52. The User hereby consents to collection of information about his location by the Service Scene, and to sharing this information with the relevant providers in order to provide him service.
53. The Service Scene is allowed at its discretion to transfer or disclose the personal information about the User to subcontractors or to other providers or third parties that are reliable service providers or partners, which are located in various regions around the world, for the purpose of: (A) giving offers for products or services at the User’s request (B) storage or processing of this information for the sake of the user (for example in cloud computing services) or to assist the Service Scene with its business activity, to verify the User’s access and to provide and improve the services of the Service Scene; (C) conducting a study, assessment, analysis or statistical goals; (D) marketing by email, according to the marketing policy of the Service Scene.
54. In addition, the Service Scene may expose to its registered users personal information relating to other users, who enroll in the services following their recommendations (e.g., through the “sharing with a friend” feature).
55. The policy of the Service Scene refers only to use and exposure of information that the Service Scene gathers from the User. If the User discloses these details to other parties through the services of the Service Scene (for example by clicking a link to any other website or other location) or through other websites around the Internet, different rules may apply to the use or exposure of the information that the User or an agent thereof will expose to them.
56. It is important to note that these third-party services of providers or of advertisers in the Service Scene may have their own privacy policy, and that the Service Scene recommends that the User carefully read it. Including a link to a third-party website or service is not a recommendation of that website or service.
57. It is agreed between the parties that for the purpose of the activity of the Service Scene, a connection to the Internet and an appropriate connection to GPS satellites are required in order to identify the User’s location, and in any case of there being no connection to these satellites, the Service Scene will not operate or will give a wrong location message.
58. The User undertakes not to express any arguments towards the Service Scene owing to problems of communication with the Internet and/or a problem of communication with GPS type communication satellites and/or an attempt to use a location where the communication with these satellites is blocked.
59. The User relieves the Service Scene of any responsibility for executing the Protection of Privacy Regulations and undertakes not to demand compensation of any type from the Service Scene owing to partial application or faults in the application of the regulations that are not intentional, malicious invasion of privacy.

Use of cookies

60. The Service Scene uses cookies for improving the user experience and correct regular operation, which may be used, inter alia, for verifying details, information security and adapting the website pages and content displayed to the User to his personal preferences.
61. There is an option for modern Web browsers to refrain from receiving cookies and an option for deleting existing cookie files. It should be noted that choosing not to enable receiving cookies or deleting existing cookie files may impair the User’s enjoyment of the use of the Service Scene.
62. The Service Scene uses various third-party services on its website in order to identify a computer of a user in order to improve the convenience of use of the Service Scene / analyze the use / manage the Service Scene / prevent fraud and improve the security of the Service Scene, personalize the experience for each user / use targeted advertisements that may interest certain users in particular.
63. Blocking of all cookies will have an adverse effect on the convenience of use. If the User blocks cookies, he will not be able to use all of the options in the Service Scene.

Indemnification and compensation for improper use of the Service Scene

64. Any User misusing the Service Scene undertakes to indemnify and compensate the Service Scene and/or its owners and/or founders and/or operators and/or managers and/or the suppliers/vendors exhibiting in the Service Scene and/or any agent thereof owing to any claim and/or expense and/or damage of any type or kind, including legal expenses, which will be sustained by the Service Scene and/or the operating company and/or the owners of the website and/or the suppliers/providers and/or agents thereof owing to the User’s acts and omissions.
65. Any User misusing the Service Scene undertakes to indemnify the Service Scene and/or the management of the Service Scene and/or the suppliers/providers and/or their employees, managers or agents for any damage, loss, loss of profit, payment or expense that they sustain – including attorney fees and trial expenses – including additional costs owing to breach and/or disavowal of these terms of use.
66. The registration for the distribution list of the Service Scene constitutes active consent by the User to accepting and following these rules.
67. The parties agree that filling in the User’s personal information in the Service Scene distribution list registration form (hereinafter: the “Registration”) constitutes consent to receive messages and advertising material of various types from the Websites and from the suppliers/providers using the Service Scene, as this is a fundamental condition for the sake of its activity.
68. In addition, the parties agree that the requirements under the Communication Law (Telecommunication and Transmissions) 5742-1982 (hereinafter: the “`Communication Law”) about stating the message type, such as: “advertisement” or “propaganda” or “donation” in the message being sent will not apply to the messages. Given the foregoing, the website will be allowed to send the user messages without stating the message type.
69. The parties agree that after the Registration, the site will not be required to state in the messages all information details set forth in the Communication Law, given the acquaintance and connection between the parties.
70. The parties agree that messages containing information only are not an advertisement as an advertisement is defined in the Communication Law on the matter of mass mailing. According to this definition, the User will not be entitled to any compensation for information messages only that are sent to him.
71. The parties agree that he User is not entitled to the punitive damages under the Communication Law for storing messages without giving notice of his unsubscribing from the distribution list, and therefore he will only be entitled to Compensation to a total amount of up to NIS 1000 for all messages that he has accumulated before asking to unsubscribe from the distribution list.
72. The parties agree that the User is not entitled to the full punitive damages under the Communication Law for storing messages after sending a request to unsubscribe him from the distribution list as he can send a repeat message and/or make contact through another communication channel, meaning that he will be entitled only to compensation to a total sum of up to NIS 4000 for all messages that he has accumulated after asking to be unsubscribed from the distribution list.
73. The parties agree that the distribution list for cellular text messages is a separate list from the email mailing list. The User is allowed to stop receiving messages in one list and continue with the other. Accordingly, a request to unsubscribe from one list does not apply to the other list and if the user wishes to stop receiving messages from the website, he must unsubscribe from each of the two lists separately.
74. The User hereby confirms that even if he believes that he has not registered previously for the distribution list or there is an error resulting in his information being added inadvertently to one distribution list or another, or the User has received advertising mail for any other reason, any email that the User receives for which the Company is not sent a warning against sending it within two weeks of the day on which it was sent to the User, or any email that has not been opened by the User, will be considered as an Email whose receipt is consensual and for which any claim and/or argument has been waived and that it does not constitute harassment.
